SC orders not to register cases against judges for judicial orders

KATHMANDU, Jan 29: The Supreme Court has ordered the court administration not to register any petition or case against any judge at individual level for their verdicts or judicial orders in future.

Giving a full text of its verdict on a habeas-corpus case, which also mentioned Bhaktapur District Court Judge Shree Krishna Bhattarai as one of the defendants, the division bench of Chief Justice Sushila Karki and Justice Jagadish Sharma Paudel stated that filing cases against judges for their judicial review could harm the independence of the judiciary.

Asna Parajuli had filed a habeas-corpus petition at the Supreme Court naming Judge Bhattarai, Bhaktapur District Office of Government Attorney, Central Jail and Office of the Prime Minister and Council of Ministers as defendants claiming her mother Pratibhanjali Parajuli was taken into illegal custody in a fraud case. 

As the bench of Judge Bhattarai denied releasing Parajuli on bail after hearing both sides of the case, the Parajuli family had filed habeas-corpus case at the Supreme Court. Judge Bhattarai had sent Parajuli into judicial custody in the fraud case related to 200 ropanis of land, which also involves her husband Arun Kumar Parajuli, the then senior director at Sunrise Bank Limited. Arun is at large since the case started.
