Govt designates all 7 high courts

KATHMANDU, Sept 14: The government has decided to transform the existing appellate courts in Biratnagar, Janakpur, Patan, Pokhara, Tulasipur, Birendranagar and Dipayal into high courts under the federal setup. 

A cabinet meeting held at Singha Durbar on Wednesday decided to form the high courts in Biratnagar for Province 1, in Janakpur for Province 2, Patan for Province 3, Pokhara for Province 4, Tulasipur for Province 5, Birendranagar for Province 6 and Dipayal for Province 7.

“We have decided to form the high courts in the seven places in the seven provinces. Likewise, the meeting has also decided to extend benches of the high courts in all seven provinces,” said Minister for Information and Communications Surendra Kumar Karki.

As per the government decision, there will be extended benches in Illam, Dhankuta and Okhaldhunga under the high court in Biratnagar. “Likewise, the high court of Province 2 will have extended benches in Rajbiraj and Birgunj,” he added. 

The extended bench of the high court of Province 3 will be in Hetauda while the extended bench of the high court of Province 4 will be in Baglung.  Similarly, there will be extended benches of the high court of Province 5 in Butwal and Nepalgunj while the extended bench of the high court of Province 6 will be in Jumla.

“The extended bench of Province 7 will be in Mahendranagar,” Minister Karki informed.   

Parliament on Sunday had endorsed three inter-related bills paving the way for establishing the seven high courts, as part of the implementation of the new Constitution.

Following Parliament's endorsement, the government on Wednesday decided to establish the high courts and their extended benches in all the seven provinces, as recommended by the Judicial Council. 

“The cabinet decision to form the high courts in each of the seven provinces signals that the country is gradually turning into a federal system,” said Karki.

The House had unanimously endorsed the Judicial Administration, Judicial Council and Judicial Service Commission Bills, which have inter-related provisions regarding establishment of the high courts, appointment of the judges and provisioning the manpower for such courts.

The new Constitution has made it mandatory to replace the appellate courts within one year of commencement of the new Constitution, which was promulgated on September 20. Article 300 (3) of the Constitution provisions that enactment of the federal laws, establishment of the high courts and dissolution of the existing appellate courts must all be done within a year of its commencement.

Meanwhile, the cabinet also decided to endorse working procedures drafted for ending caste-based discrimination and promoting the rights of the Dalit community.

Likewise, the meeting appointed Kulman Ghising as acting chief of Nepal Electricity Authority, as then executive director Mukesh Kafle resigned from the post last week.
