KATHMANDU, Sept 2: CPN-UML Chairperson KP Sharma Oli has filed a writ petition in the Supreme Court on Wednesday against CPN (Unified Socialist) and Speaker Agni Prasad Sapkota. He has accused Speaker Agni Prasad Sapkota of helping members of the House of Representatives to open a new party without releasing them from the previous party.

The writ petition claims that it is against the law for the Election Commission to register a new party by verifying the signatures of the party lawmakers, who are dismissed by the party. Chairman Oli has filed three writs simultaneously. 

In the writ, the Election Commission, the Office of the Prime Minister and Council of Ministers, Federal Parliament Secretariat, Speaker Sapkota, Madhav Kumar Nepal, who was expelled from the CPN (UML), UML, 14 federal and 2 provincial assembly members and the speaker of Lumbini have been made defendants.

CPN-UML had decided to expel 14 members of the House of Representatives from its party on August 9. The writ petition claims that the information and decision to this effect was registered in the Federal Parliament Secretariat on August 17 for the implementation of the party's decision.

The writ petitioner claims that it is illegal to form a new party based on the 14 members of the House of Representatives who were expelled from the CPN-UML. "As a new party has been formed, the correspondence and decision are illegal,” reads the writ petition. 

Similarly, the writ petition claims that the Election Commission identified the petitioners who did not sign at the beginning and later registered a separate party without any reason and without completing the due process.
