DEKENDRA MURDER CASE
SC stays instruction issued by AG to halt murder investigation

REPUBLICA ONLINE

(Update II)
KATHMANDU, Jan 15
: Supreme Court (SC) stayed instructions issued by the Attorney General (AG) Office to halt investigation process on murder of journalist Dekendra Thapa.

Responding to writ petition filed by Advocate Govinda Prasad Sharma Bandi on Sunday, a single bench of Justice Kalyan Shrestha said that the instruction issued by the AG office against the ongoing investigation is against the Interim Constitution and fundamental principle of criminal justice.

The court has also directed the Dailekh Police Office and District Attorney General Office to inform the apex court if it faces any hurdles in the ongoing investigation.

Sharma in his petition demanded an interim order to annul the directives of the AG, who is the government´s legal advisor.

The petitioner had argued that the directives the AG would affect the ongoing interrogation and prosecution process regarding the killing of Thapa.
